The Office of the Special Prosecutor (OSP) has sought to douse the effect of the US Court findings of the lack of credibility of the charges by the Office put up against the Former Finance Minister, Hon. Ken Ofori Atta.
In a statement on the Office's authorised social media account, the office indicated that the decision of the Court was that in immigration proceedings and not in extradition proceedings commenced by the Office of the Attorney-General and Minister of Justice.
Per the statement of the independent state agency whose prosecutorial powers now appear to be in coma owing to the decision of the High Court in Ex Parte Peter Hyde, "..the extradition packet is not before the immigration court; and the credibility or otherwise of the criminal charges against Mr. Ofori-Atta would be determined by the courts in Ghana, who have jurisdiction to determine his guilt or innocence."
According to the terse reaction of the OSP to what appears to be a blow to the media campaign waged by the Special Prosecutor himself, Kissi Agyebeng, and the prosecution drive of the OSP against the former Minister, "Mr. Ofori-Atta still remains a citizen of Ghana and he is still amenable to be extradited to Ghana if so decided by the extradition court in the United States."
Charges not credible
In the morning of Tuesday, the 16th day of June, 2026, Lawyers for Mr. Ken Ofori Atta announced residency status allowed by the US Court and the view of the Court of the charges leveled against Mr. Ofori Atta in Ghanaian Courts.

Below is the full statement issued by the OSP:
The Office of the Special Prosecutor (OSP) has taken note of media reports and a publication attributed to a law firm in Ghana that Mr Kenneth Nana Yaw Ofori-Atta has been granted permanent residency in the United States resulting from an immigration court finding that it did not find the criminal charges filed by the OSP in Ghana against Mr. Ofori-Atta credible.
The OSP states that it is not involved in immigration hearings in the United States involving Mr. Ofori-Atta. The OSP’s involvement is in respect of extradition proceedings against Mr. Ofori-Atta through the Attorney-General as the central authority.
The OSP states that the extradition packet is not before the immigration court; and the credibility or otherwise of the criminal charges against Mr. Ofori-Atta would be determined by the courts in Ghana, who have jurisdiction to determine his guilt or innocence.
Further, Mr. Ofori-Atta still remains a citizen of Ghana and he is still amenable to be extradited to Ghana if so decided by the extradition court in the United States.
