On the 31st of October 2023, Justice Hafisata Ameleboba, a Court of Appeal Judge sitting as an additional High Court judge at the Divorce and Matrimonial Division of the High Court annulled the decade-long marriage between the famous Ghanaian footballer, Asamoah Gyan and his wife. Justice Ameleboba distributed properties of the parties, settled custody of children and alimony as follows:

DEMANDS OF ASAMOAH GYAN

1) His marriage to Gifty Gyan be annulled as she was married prior to marrying him and thus, their marriage void.

2) A DNA test ordered by the court to determine the actual paternity of his 3 children from the marriage.

3) An order by the court that he maintains the children until the results of the DNA test.

DEMANDS OF GIFTY GYAN

1) The court should dissolve her marriage to Asamoah Gyan.

2) Custody of the children from the marriage should be given to her.

3) Asamoah should pay five thousand pounds monthly for the maintenance of the home and upkeep of the three children from the marriage during the divorce matter and after same.

4) Asamoah Gyan should be ordered to pay her cost of the litigation.

5) Asamoah Gyan should pay a lump sun of 1 million dollars ($1,000,000)to her.

6) A house in UK should be given to her.

7) She should be given 50% share in the following properties which were acquired during their marriage.

a) Their first matrimonial home located in East Legon.

b) The famous "Basilica" home of Asamoah Gyan situated at Weija.

c) A house called Baby Jet Heights situated at East Legon.

d) A house at Michel Camp, Tema.

e) An apartment of Asamoah Gyan at West Adenta.

f) A printing press in Dubai.

g) A warehouse at Manet, Spintex.

h) Rolls Royce Phantom with registration number BJ-3-15; Porche Cayanne; Mercedes Benz SLK; Mercedes Benz Sprinter bus with registration number JET 3-16; Black Mercedes Benz V class with registration number BJET 3-15; Doge vehicle.

8) 50% of Asamoah Gyan's interest in the following entities

a) Baby jet Airlines

b) Jetlink Events and logistics

c) Gyan investments Ghana limited.

d) Paradise Pac drinking water.

e) Baby jet boxing promotions.

f) BJ Sports Bar & Restaurant.

DNA TEST RESULTS

The results showed that Asamoah Gyan is the actual father of the three children from their marriage entered into on 31st August 2013 to 31st October 2023.

ANNULMENT OR DIVORCE?

The court annulled the marriage. The cross-petition by Gifty Gyan was denied as the marriage between her and Asamoah Gyan was voidable owing to misrepresentations made to Asamoah Gyan before entering the marriage.

CUSTODY OF CHILDREN

Madam Gifty Gyan was given custody of the three children who are domiciled in the UK with her.

MAINTENANCE ORDERS

Asamoah Gyan is to pay Twenty-Five Thousand Ghana Cedis a month (GH¢25,000.00) to Gifty Gyan for the maintenance of the children and the upkeep of their home. Payment should be done 1st of each month beginning from November.

Asamoah Gyan is ordered to pay educational and medical expenses of the children as Gifty Gyan is unemployed and cannot cater for the welfare of the children.

PROPERTY SETTLEMENT

The court refused all the demands of Gifty Gyan so far as 50% interest in the listed properties and companies are concerned. The court however settled the following in her favour:

a) A house bought by Asamoah Gyan at Spintex in Gifty's name.

b) A Range Rover car bought by Asamoah Gyan for his wife during their marriage.

c) A BMW and Infinity vehicle acquired by Asamoah Gyan for his wife before their marriage but in the possession of Asamoah Gyan should be returned to her in a motorable shape.

d) A land at Afienya bought by Asamoah Gyan for a gas station should be given to Gifty.

e) A house in UK bought by Asamoah Gyan for his wife and children should be given to her to be held in trust for herself and her children.
