The President has disclosed a savings of over 10 trillion cedis in savings by the office of the Attorney General under the tenure of the President. The President made the disclosure in his address to Parliament in the afternoon of 27th February, 2024.
Following the disclosure, The Law Platform through its sources and some research, provides some instances of representation from the Attorney General to resist claims against the state for payment to be made from the public purse:
1. The 2021 Supreme Court judgment of NDK FINANCIAL SERVICES v AHAMAN ENTERPRISE, ATTORNEY GENERAL & ALEX ADUKO [TLP-SC-2021-95] saw the rejection of an amount of 1.2billion cedis by NDK Financial Services against the State.
2. In 2023, the Attorney-General fought claims by Cassius Mining Limited at the Permanent Court of Arbitration for an amount of $300 million translating into some 3.3billion cedis.
3. The Permanent Court of Arbitration in 2023 rejected claims of over $60 million by Beijing Everyway Traffic & Lighting Technical Company against the government of Ghana. The Attorney-General ensured representation for and on behalf of Ghana in the company of the Solicitor General and other officers of his Ministry.
4. The Attorney General through an application filed and moved at the Kumasi High Court in 2021 saw the setting aside by Justice Diawuo of a judgment debt of over $15.7 million against the State.
5. The Bank of Ghana as a segment of the State albeit independent in operations through private Attorneys in Ghana and in the UK rebuffed the claims of Sibton Switch Limited against the state to a tune $478 million. The forum for the claims brought by Sibton Switch was the London Centre for International Arbitration.
The Law Platform will offer more instances of representation by the Attorney-General leading to savings indicated by the President in his address in the coming days.
