Mr. Samuel Bryan Buabeng, a private citizen of Ghana has filed a writ at the Supreme Court invoking its original jurisdiction seeking declarative reliefs to the effect that a vacancy on the Council of State suggests a the non-constitution of the council of State and thus, the resignation of the former Chief Justice of the Republic of Ghana, H/L Justice Sophie Akuffo from the Council of State since September, 2025 means the body is not properly constituted.

In the writ of Mr. Buabeng filed today, 7th day of September, 2026, the Plaintiff prays for a declarative relief from the apex Court that the failure or refusal of President J.D. Mahama to appoint a former Chief Justice in the stead of Justice Sophia Akuffo for nearly one year since her resignation amounts to an unconstitutionality.

Per the filed writ through his lawyer, the learned Jonathan Asare Esq., the Plaintiff prays for "A declaration that upon a true and proper interpretation of Articles 89(1) and (2)(a)(i) of the 1992 Constitution of the Republic of Ghana, the President of the Republic of Ghana acted and continues to act unconstitutionally by refusal or failure to appoint a former Chief Justice to replace Chief Justice (Retired) Sophia Akuffo who resigned as a member of the Council of State in September, 2025."

The Plaintiff on the back of declarative reliefs sought seeks orders from the Supreme Court directed at the President that "the President pursuant to Article 89(2)(a)(i) to consult with Parliament within 14 days, and to appoint within 48hours upon the said consultation with Parliament, a former Chief Justice of the Republic of Ghana as a member of the Council of State."
