Squatters, Trespassers, and the Law: A Call for Clarity & Certainty
Before the Supreme Court in the above case drew a distinction between squatters and trespassers, it made sure it had defined “squatter”. It did not however define trepassers before concluding that trespassers are those who enter onto a land and make a claim of an interest in it. Earlier in this paper, the point was made clearly that not all trespassers make a lawful claim to land they trespass upon.
