The Apex Court constituted by Pwamang, Kwoffie, Darko Asare, Adjei and Suurbaareh JJSC on Tuesday, the 23rd day of June, 2026 in the case of Republic v High Court, Koforidua Ex Parte: Emmanuel Opare & 2 Ors. Suit No. J5/70/2026 has registered its strong exception to attacks by a lawyer on Justice George Krofa Addae in a certiorari motion filed against a decision of the Koforidua High Court.
In his motion filed on the 28th day of May, 2026 seeking to quash an order of the High Court, Counsel for Applicants made direct attacks on Justice Addae impugning his competence and ability to further handle the matter of the Applicants at the High Court.
Counsel for Applicants while being subjected to a barrage of questions on the incompetence of his certiorari motion from Pwamang and Adjei JJSC, Justice Darko Asare in his usual calm speech, jumped into the interrogations and stirred the subject of intemperate language.
Justice Darko Asare drew Counsel for Applicants' attention to paragraph 28 of his Motion for certiorari against an order of the Koforidua High Court presided by H/L Justice George Krofa Addae. His Lordship Darko Asare JSC read out portions of the paragraphs and registered his objection to the words used and the suggestions it seeks to create.
The vexed paragraph 28 of the motion of Counsel for Applicants' which he relied on for his case reads as follows: “That His Lordship Justice George Krofa Addae has often displayed a lack of fidelity to the law, court procedure, rules and processes and has proceeded to grant executory order in this matter in spite of the pendency of stay of execution processes and procedures.”
Justice Darko Asare who flanked Justice Pwamang on his immediate left moved from paragraph 28 to 36 of the affidavit accompanying Counsel for Applicants' motion. The words “That the actions of His Lordship Justice George Krofa Addae constitute consistent deliberate and injurious acts” incurred further displeasure of the Supreme Court judges which was visible on the face of members of the panel.

Adjei enters the fray
Justice Dennis Dominic Adjei who is an experience law lecturer and has the rear judicial experience on both local and international benches queried Mr. Agbenoto, in what appeared to be an expression of his disappointment in Counsel for Applicants' language in the following words: “Is that what you are taught at the Bar?”
Justice Pwamang who was not having none of it took over the baton from his brother, Adjei JSC, and as if standing in the shoes of his junior brother, H/L Justice Krofa Addae J. said that “we are here doing our work and your are personalizing it. You must withdraw”.
Withdrawal and apology
Overwhelmed by the disapproval of the Court, Counsel for the Applicants withdrew the vexed paragraphs and submitted to the Court that that is not his nature in the numerous times he has appeared before them. He thereafter continued to argue his motion which was rejected in unanimity by the Court.
Counsel for the interested parties rose, as if he had sensed a wounded prey and was ready to pounce was met with requests from Kwofie JSC why he was on his feet when his work of opposing the motion of Counsel for Applicants' was literally done by the Court.
Counsel for the interested parties informed the court that he rose only to join his learned friend render an apology to the Court for his words which the Court per its ruling described as “distasteful”. The Court entered into silence mode while the President wrote the ruling of the Court.
In the voice of Pwamang JSC, the Court held that the motion of Counsel for the Applicants was without merit. On cost, the Court held that owing to the apology rendered and the withdrawal of the said “distasteful statements”, cost of GH¢30,000 was awarded in favour of the interested parties contrary to GH¢200,000 requested by Counsel for the interested parties.
