The Apex Court presided by the experienced Justice Gabriel Scott Pwamang shall hear the merits of the certiorari application brought by Hon. Mathew Nyimdam whose election victory was nullified by the Tamale High Court.
The Supreme Court after its sitting on the 16th day of December, 2025 ordered for service of the certiorari application through substituted service by posting same on the Tamale High and Circuit Court's notice Board and on the whatsapp number of the 1st Respondent, Mr. Nsala Wakpal.
On the last adjourned date, the Court in unanimity stayed the organisation and holding of by-elections for the Kpandai Constituency pending the final outcome from the Court today, the 13th day of January, 2026.
Service effected, Opposition filed
The Law Platform can confirm Mr. Wakpal has caused his lawyers to file his affidavit in opposition to the certiorari application of Mr Nyimdam whose seat, pursuant to the orders of the Tamale High Court Presided by Justice Bart-Plange has been declared vacant by the Clerk to Parliament who is named as a Respondent to the Certiorari Application.
The affidavit of Mr. Wakpal was filed upon due service of the Certiorari application on him by way of substitution pursuant to the orders of the Supreme Court.
Panel
The panel to hear the application and determine same is constituted by Pwamang (Presiding), Amadu Tanko, Kulendi, Asiedu and Kwoffie JJSC.
