The Right of the ‘Mad Man’ and the Safety of the Road User
The paradox, however, is glaring; despite these protections, many persons with mental disorders roam our streets in conditions that undermine their dignity and endanger their lives and those of others. Their continued exposure to traffic hazards, violence and health risks arguably violates not only public safety norms but also their own constitutional rights to life, dignity and health care.
