If a student is allocated a specific room, pays a defined accommodation fee, and enjoys exclusive possession for a fixed period, the arrangement may constitute tenancy in substance. Courts consider substance over form. The label accommodation fee does not determine legal character. If the university retains unrestricted rights of entry and relocation, the arrangement may instead be a licence.
