Madam Cecilia Abena Dapaah in a letter dated the 19th of October, 2023 has responded to the recusal petition of the Special Prosecutor against the Presiding Judge in the court matter between the Special Prosecutor and herself.
The embattled former Minister of Sanitation is seeking from the Chief Justice a copy of the recusal petition and clarity from the office of the Chief Justice whether the recusal petition in question has been withdrawn or not.
Chief Justice yet to respond
Lawyers for Mad. Dapaah were in court on the morning of today, 25th of October 2023, for a possible response from the Chief Justice on the recusal petition and the hearing of an application for stay of proceedings filed and moved by the Special Prosecutor on the 18th of October, 2023. None of the above anticipated events came off.
Mad. Cecilia Dapaah in the company of her lawyers led by Mrs. Victoria Barth were invited to the chambers of Justice Edward Twum who has stayed his hand until a green light from the Chief Justice. Justice Twum informed Mad. Dapaah and her lawyers the new adjourned date for hearing of the application for confirmation of seizure and freeze of Mad. Dapaah's properties. Justice Twum made it known to the former Minister and her lawyers the absence of a response from the Chief Justice on the recusal petition since its lodging. Justice Twum also informed them of the new hearing date for continuation of hearing of the matter which is the 8th of November, 2023.
Delay and Disappointment
In an interaction with The Law Platform, lawyers for Mad. Dapaah expressed disappointment on the absence from court of lawyers from the Office of the Special Prosecutor. According to lawyers for Mad. Dapaah, they cannot tell nor do they have any signal from the office of the Chief Justice as to when her decision on the recusal petition will be available for the continued hearing of the matter.
