The anticipated second confirmation application by the Office of the Special Prosecutor (OSP) billed for the morning of Thursday, 12th of October, 2023 was unceremoniously cancelled when the Presiding judge broke the news that the OSP has written to the Chief Justice requesting for a new panel to hear the application.

Today's sitting was ordered by Justice Edward Twum after granting the application for the abridgment of time heard yesterday, Wednesday 11th of October, 2023. Parties were present in court same as counsel for Mad. Dapaah. Legal representation for the OSP was absent.

In a calm manner wearing a smile, Justice Edward Twum announced to the visible displeasure of Mrs. Victoria Barth, lead counsel for Mad. Cecilia Dapaah, that the OSP has petitioned the Chief Justice for his recusal. He indicated the move places ice on today's hearing and indicated his inability to further hear the matter subject to a decision from the Chief Justice.

Mrs. Victoria Barth displeased and surprised by the news requested the record to capture her reaction to the surprise. She indicated that the OSP has never questioned the competence of the judge and thus her surprise by the move. She made her visible displeasure known in words as she said she is unhappy about the development. In an address where portions were directed at the arrow head of the OSP, she said the petition for recusal was a "deliberate ploy to frustrate hearing and a desperate attempt to avoid his own ill-fated application."

She went on to say that "Nevertheless, the inevitable cannot be avoided and there shall be a day of reckoning."

She also drew into her ever present arsenal on professional legal ethics as she said courtesy and proper professional conduct required that she will be placed on notice to avert the inconvenience of her presence in court. She drew another dagger at the OSP head by saying he is not above the law.

Justice Edward Twum therefore adjourned hearing to Wednesday the 18th of October, 2023 for hearing subject to the decision of the Chief Justice.

The same fate befell the substantive case of Republic v Cecilia Dapaah & Another. Justice Twum adjouned same to the same adjouned date subject to the decision of the Chief Justice.
