The Supreme Court presided by Pwamang JSC, President of the Panel, Adjei Frimpong , Gaewu, Dzamefe and Ameloboba JJSC has ordered the office of the Attorney-General and Justice Ministry (A-G) to respond to the application for discoveries and the interlocutory injunction application filed by Democracy Hub against the agreement reached by the Foreign Affairs Ministry with the United States of America for the former to receive deportees of the latter.
In their orders dispatched in the voice of the President of the Panel, Justice Gabriel Scott Pwamang, the Supreme Court panel upon conference for some 3-5 minutes while sitting to decide on the move to take in the absence of the Attorney-General and absence of processes reacting to the Applications indicated that the matter brought by the Plaintiff/Applicant, Democracy Hub had significant public interest.
Owing to the public interest, the Supreme Court ordered the Attorney-General to "react within two weeks to the application for discoveries" filed by the Plaintiffs, Democracy Hub.
Barker-Vormawor pushes for hearing without A-G
The learned Oliver Barker-Vormawor who had the company of his learned friend, Edem Tusah told the Court upon inquisition about his filed applications that the Plaintiff wanted to move all of its applications, that is , injunction and discoveries subject to the order of preference for moving the application by the Court.
Poised with his lectern firmely placed before him at the Bar and his Law reports ready to argue his motion, he urged the case of GHANA CENTER FOR DEMOCRATIC DEVELOPMENT & ORS v. ATTORNEY-GENERAL [TLP-SC-2023-20] on the Supreme Court wherein the Supreme Court decried the slow conduct of cases before the court. He thus prayed the Court to take the applications of Democrary Hub before His Lordships to deter the conduct of the A-G.
Unfortunate A-G absent -Pwamang
With the Bench satisfied with service of the writ and applications on the Attorney-General upon inspecting the affidavit of service of the applications, Justice Pwamang made it known to the Court that the discoveries being sought by the Applicant was going to be useful to the Court.
Pwamang JSC, who now has his attention fully on Judicial duties after the end of his duties under the Article 146 Committee said "it is unfortunate the Attorney-General is not here". His Lordships therefore found it prudent to give the A-G some time to respond failure of which the Court shall decide on the application of the Plaintiff- Democracy Hub.
Adjourned to 12th November
The Court ordered service of proceedings of the Court on the Attorney-General and adjourned the hearing of the applications of Democracy Hub to the 12th day of November, 2025 at which time the Court is hopeful the A-G would have filed an opoosition or otherwise to the injunction and discoveries application filed by the Plaintiff.
