The Chief Justice in a letter dated 4th March, 2024 has directed all judges especially lower court judges not to entertain police prosecutors in cases whose monetary value exceed GH¢500,000.
The said letter to judges indicated that such cases ought to be referred to the Office of the Attorney-General for study and advice. The letter from the Chief Justice references a letter from the Office of the Attorney General and Ministry of Justice dated 7th February, 2024 where the learned Attorney-General (A.G) seeks to remind the Judicial Service of the monetary limit for police prosecution in lower courts.
The letter from the A.G was necessitated as the directive to police prosecutors by the AG not to prosecute cases with monetary value beyond GH¢500,000 has been disobeyed in some instances. The letter from the A.G addressed to the Chief Justice was thus to bring the attention of the Judicial Service to the directive and ensure compliance with same through judges.
The letter of the C.J reads in part as follows:
"ALL JUDGES
NOTICE OF PROSECUTORIAL LIMITS OF POLICE PROSECUTORS I write with reference to the attached letter from the Office of the Attorney-General and Ministry of Justice dated 7th February, 2024 on the above-mentioned subject.
The Attorney-General is by the said letter notifying the Service that, Police Prosecutors have been directed to prosecute cases with monetary value not exceeding the amount of GH¢500,000.00. The letter further indicates that any case with monetary value above this limit must be referred to the Office of the Attorney-General for study and advice. You are kindly requested to take note accordingly."
