The consolidated cases brought on the steam of the unprecedented suspension and removal of the Chief Justice of the Republic of Ghana, Justice Gertrude Araba Esaaba Sackey Torkornoo, marks an epoch in the constitutional law and jurisprudence of Ghana.
The cases showcase the balance struck by the court in judicial accountability and security. The cases offer an authoritative voice from the Apex Court on the removal processes of a judge and a Chief Justice and the application of natural justice principles in a prima facie determination and advice from the Council of State in the removal process.
The decisions also lays out guiding principles in the work of the committee set up by the President or the Chief Justice for the removal of a judge or Chief Justice respectively, after the determination of a prima facie case.
Justices Tanko Amadu, Dennis Adjei and Suurbaareh JJSC made their voices heard in the two consolidated cases. All other Justices empaneled on the two cases offered muted concurrence to the expansive voice, as per the two decisions, of H/L Justice Tanko Amadu JSC.
