The learned Kwame Akuffo in a terse but pointed article has called into question the constitutionality of the impeachment processes spelt out under section 15 of the Office of Special Prosecutor Act, 2017 (Act 959) (OSP Act).
In reliance on the recent case of FRANCIS OSEI-BONSU v ATTORNEY-GENERAL [TLP-SC-2024-145] Kwame Akuffo, who is dependable in courtroom advocacy contends that the impeachment process spelt under section 15 seeks to illegally amend Article 146 of the 1992 Constitution.
In his words "Section 15 of the Act [OSP Act] is clearly a backdoor attempt to amend the 1992 Constitution, and the same is grossly unconstitutional. Needless to say, it cannot form the basis of a Petition which has been referenced by the President, to the Chief Justice, for the consideration of Impeachment Proceedings."
