Justice Edward Twum of the Financial and Economic Division of the High Court has condemned the use of strong words by the Special Prosecutor in an affidavit in opposition against moves by Mad. Cecilia Dapaah to abridge the time within which the court will hear the application by the Special Prosecutor to confirm the re-seizure and re-freeze of monies found in the house of Mad. Cecilia Dapaah.
Justice Edward Twum while hearing counsel for the Special Prosecutor, Esther Fafa Tetteh, said the "application in opposition (of the Special Prosecutor) used intemperate language and should not be the act of lawyers." He further went on to say that lawyers are only litigating, signalling the need for lawyers to draw themselves away from their emotions in speech at the bar and language employed in court documents.
This condemnation by the court came some time after the reading of a portion of the affidavit in opposition by Mrs. Victoria Barth, Counsel for Mad. Cecilia in open court when a copy of the said affidavit was given to her. The affidavit which will soon be published by The Law Platform read in portion as follows:
"the application is without merit situated in unhelpful alarmism of the unwarranted and exciting helplessness kind and a denounceable attempt to gag and deprive the Republic of its reaction to the affidavit in opposition filed by the respondent therein"
The application to abridge time brought by Mad Cecilia Dapaah if granted will enable the court hear the confirmation application by the Special Prosecutor earlier than 18th of October, 2023.
Arguments by the Office of the Special Prosecutor
Lawyers of the OSP led by Esther Tetteh were of the view, amongst others that the application for abridgement if granted will dis-entitle them from filing supplementary affidavits to their application for confirmation.
