The Council of State under Article 146 OF THE 1992 Constitution has recommended the dismissal of the petition brought by Prof. Stephen Kwaku Asare for the removal of the learned Chief Justice, Her Ladyship Justice Gertrude Torkornoo.

The petition has thus been dismissed by the President for being unmeritorious, frivolous and vexatious. The dismissal was contained in a release under the hand of the Head of Communication at the Presidency on the 6th day of January, 2024. The President also offered a well reasoned response to the Petition with heavy reliance on the case of Agyei-Twum v. Attorney-General and Another [2005-2006] SCGLR 732.
