The Board of Governors of Wesley Girls' High School on the 16th day of March, 2026 filed a motion with notice to parties to the case for the Supreme Court to rely on its inherent jurisdiction to strike out the writ of the Plaintiff-Lawyer, Shafic Osman for want of capacity of the Board of Governors of the School.
In their 36-paragraphed motion [a copy of which is below], the Board through their lawyers, Messrs Cann, Quashie & Co. informs the Court of irrgularities in service of the writ of the Plaintiff whose case is brought by the learned Victor Nsoh Azure of Kpemka & Co PRUC.
Writ a nullity
On the irregularity of the writ itself, the Board of the famous Ghanaian Girls' school whose training is reputed to be steeped in Methodism informs the Court that the Board of Governors of the School is not a juristic person.
The motion of the Board whose deponent is an Assistant Headmistress of the School informs the Court that the land of the school and the properties thereon just like other properties of the Methodist Church are held by the Trustees of the Methodist Church which is the proper person the writ of the Plaintiff ought to have been brought against and not the Board.
Shafic Responds
In his relatively terse affidavit opposing the motion of the Board of Governors of Wesley Girls' High School, the Respondent suggests to the Court that the Education Act madates a Board of Governors of Secondary Schools, suggesting the legal personality of the Board of Wesley Girls.
The Respondent suggests to the Court that it is known to the Court that the administration of Secondary Schools are done by Boards of Governors and thus, the motion of the Applicant-Board, misconceived.
The Respondent per his opposition filed on the 24th day of March, 2026 further suggested to the Supreme Court that there are other parties to the matter with reliefs directed against the said parties, that is the Attorney-General and the Education Service. Suggesting a salvation for the writ assuming the claim of incapacity of the Biard is made out.
The Court shall hear the motion of the Board on Tuesday, the 31st day of March, 2026.
