The Office of the Attorney-General and Justice Ministry has opposed the motion filed by Dr. Yaw Twerefour against the Finance Minister and the Administrator of the District Assembly Common Fund (DACF) for injunctive orders restraining them from making any transfers or payments into the personal bank accounts of Members of Parliament (MPs) from the District Assemblies Common Fund.
In the affidavit of the A-G whose accompanying statement of case is signed by the Deputy Attorney-General Hon. Dr. Justice Srem-Sai, the A-G admits to the transfer of funds from the DACF into the personal bank accounts of MPs.
The A-G submits, through the depositions of John Enchill, Assistant State Attorney per the affidavit in opposition filed on the 19th day of June, 2026 that the transfers or payments from the DACF into the personal bank accounts of MPs in and itself does not breach or violate transparency or accountability as claimed by the motion and writ of Dr. Twerefuor.
The A-G submits at paragraph 9 of their opposition "9. That in further response to Paragraph 1 and 12 of the affidavit in support of the motion, I am advised by counsel, and verily believe the same to be true that the law does not bar or prevent the 2nd Defendant from paying the monies - which are by law, due and payable to Members of Parliament - into the respective personal bank accounts of such Members of Parliament."
The A-G deposes to and also argues per his statement of case attached to their affidavit in opposition that the balance of convenience is titled against the Applicant as the restraint sought is that on a state institution.
