The Office of the Attorney-General and Ministry of Justice (A-G) has reacted to the motion filed by lawyers of Mr. Hanan Abdul-Wahab seeking the High Court, Criminal Division to strike out the charge sheet filed against Mr. Hanan and his wife for offences of stealing, defrauding by false pretences, money laundering and others.

Per the affidavit in opposition filed on the 16th day of July, 2026 against the motion filed by Mr. Richard Gyambiby of Dame & Partners, the A-G amongst others admits of the duplicity of counts contained in the charge sheet but suggests to the Court that A-G is however not barred from bringing such counts in a charge sheet.

Per the 3-page affidavit in opposition a copy of which may be read/downloaded below, the EOCO-Officer deponent, Rabiatu Abdulai submits to the Court that "I am advised in respect of the averments in Paragraphs 14 and 15 of the affidavit in support of the motion, and I verily believe the same to be true that while the law prohibits charging more than one offence in a count, several actions which (as in this case) constitute an offence may be put in one count.

8. That I am advised in respect of the averments in Paragraphs 31, 32, 3 and 34 cf the affidavit in support of the motion, and I verily believe the same to be true that while the Court may not, ni respect of the same facts, convict a person for stealing and for defrauding by false pretences, a prosecutor is not barred from charging the two offences in respect of the same facts.

9. That in response to the averments in Paragraphs 35 and 36 of the affidavit in support of the motion, I am advised and I verily believe the same to be true that the claims therein are dependent on the success of the claims in the preceding paragraphs, which preceding claims I have already traversed."
