The Court of Appeal constituted by Sophia Rosetta Bernasko-Essah(Presiding), Dr. Ernest Owusu-Dapaa and Ayitey Armah-Tetteh, JJA has adjourned indefinitely the case of Republic vrs Sedina Tamakloe Attionu (Suit No. H2/17/2026) to deliver a ruling on the motion filed by the Office of the Attorney-General and Ministry of Justice to stay the decision of the selfsame Court in the case of SEDINA TAMAKLOE ATTIONU v. THE REPUBLIC [TLP-CA-2026-38].

In an empty Courtroom save for only the panel, Court Clerks and Counsel for the Appellant/Applicant, the learned Enoch Deegbe who enjoyed company of the learned Sydney Antonio, and Counsel for the Respondent, the learned Hilda Craig, the Court heard the motion and arguments in support and against same.

One hour conference

The Court after hearing the motion rose for nearly two hours to conference to return their decision. Upon their return, the Court through the President informed the Court that the panel could not conclude on conferencing and thus, they could not deliver a ruling on the motion of the A-G to stay the judgment of the Court freeing the Respondent, Sedina Tamakloe Attionu.

The Court of Appeal which was constituted and sat to hear the motion less than 24 hours after the filing of the stay of execution and appeal of the A-G indicated to the Bar that the Court shall seek a warrant from the learned Chief Justice, H/L Justice Paul Baffoe Bonnie to deliver its ruling in due course, thus, moving the ruling into the legal vacation which commences on the 1st day of August, 2026.

In what appears to be a hastily filed appeal (a copy of which may be read below) following immense public backlash to the decision of the Court of Appeal quashing the High Court conviction and 10 year sentence of Mad. Sedina Tamakloe Attionu, the A-G ensured service of the Notice of Appeal and Motion for Stay on Mad. Sedina Tamakloe Attionu in the evening at Nsawam prison.

The Court of Appeal and all other Courts in Accra which have been instructed not to sit for the closing event of the 150th anniversary celebration of the Supreme Court (See below for circular from Judicial Secretary) sat to hear the motion for stay despite the less than 24 hours filing and service on Mad. Sedina Tamakloe.
