The respected and learned Thaddeus Sory has implored the Chief Justice of the Republic, Her Ladyship Justice Gertrude Sackey Torkornoo to give attention to the rules of procedure that require the delivery of judgment by a court within legally provided timelines.
Mr. Sory made this recommendation to the Chief Justice in an interview with The Law Platform on the 4th of April, 2024. In a detailed interrogation of efforts by the Chief Justice to reduce caseload and enhance efficiency in the administration of our courts through the Court Shift System, Mr. Sory questioned if the Chief Justice appropriately diagnosed the cause of the huge caseload in some of our courts and if the Shift Court System is indeed the best solution to the identified problem.
Mr. Sory in his interrogation of the Shift Court System which our investigations show delay in its implementation in some of the courts designated to pilot the policy sought to shine the light on the ineffectiveness of some judges which engender case pile up and inefficient justice delivery.
Per Mr. Sory, "The case load also results in many instances from the manner in which some Judges handle simple matters before them. Motions for joinder, substitution of parties, substituted service, default judgment, injunctions, directions in some courts remain static for a very long time. Some courts tolerate and I will say downright unethical behavior on the part of lawyers who clearly file applications, the obvious intent of which is to stall the proceedings before the court and the Judges are indulgent even when their attention is drawn to the fact."
Mr. Sory also suggests in a straightforward voice the possible weakness in the operation of court registries as the reason if not a contributing reason for inefficient court administration leading to the pile up of cases before our courts.
