In the 5-2 decision of the Supreme Court with Justices Baffoe-Bonnie and Amadu Tanko voicing the opinion of the majority, the Supreme Court developed the constitutional law of Ghana by expanding the right to vote at the political party level. The apex Court expanded the frontiers of democracy in political party electioneering in the case of PROF. KWABENA FRIMPONG BOATENG & ORS v. NEW PATRIOTIC PARTY & ORS [TLP-SC-2026-21].
The Supreme Court has given political parties one year to phase out the delegates system. This shall effectively allow all members of political parties voting rights for flagbearers and parliamentary candidates of during their internal contests. Justice Asiedu who enjoyed concurrence from Ernest Gaewu JSC departed from the majority on the panel and voiced the dissenting opinion of the panel.
