Limit on the number of shares a company can buy back: an inflexible rule of thumb?
Thus, section 58(1)(d) prohibits a company from acquiring by way of purchase or otherwise its issued shares or that of its holding company. This prohibition exists to prevent companies from arbitrary altering their share structure, and to protect shareholders’ interest.
