The Supreme Court by a ruling today, the 16th day of December, 2025 has ordered the service of the certiorari application to quash the judgment of the Tamale High Court and the application to suspend the by-election in Kpandai on Daniel Nsala Wakpal by way of Whatsapp, posting at his home address and notice board of the Tamale High and District Courts.
The Supreme Court constituted by Justices Pwamang, Amadu Tanko, Kulendi, Asiedu and Kwoffie JJSC upon being satisfied that the phone number of the 1st Interested Party, Nsala Wakpal was active, and his address as indorsed on his petition at the Tamale High Court ordered that the certiorari and suspension application be served on him by posting at the said house address and whatsapp number.
Number on nomination forms?
The Court in the voice of Kulendi JSC inquired from Counsel of the Electoral Commission if Mr. Wakpal supplied his phone number when filing and submitting his nomination forms and if the number is whatsapp registered.
The learned Justin Amenuvor who was unsure of the whatsapp registration of the number answered in the affirmative to the supply of the number of Mr. Wakpal as part of his nomination forms.
Justice Amadu Tanko in his usual audible and commanding voice told Counsel for the Electoral Commission that there was a forum with Civil Society on the design of nomination forms to ensure that the numbers of candidates are readily available to prevent tricks by parties when there is an election dispute.
Service through posting and whatsapp number
Learned Counsel for the Applicant, Gary Nimako Marfo suggested to the Court that the Certiorari application should be served by posting the application at his home address and on his whatsapp number.
Mr. Marfo informed the Court that they have the number of the 1st Interested Party, Daniel Nsala Wakpal. He told the Court that Hon, Nitiwul who was representing Mr. Nyindam in Court has had text conversation with him on the number.
Justice Pwamang ordered Mr. Marfo to supply the number which was penned down by the Court. Justice Amadu Tanko asked if it was active, to which Mr. Marfo answered, "there is momo on it" to laughter from the entire Court.
500 cedis sent to number in Court
To demonstrate that the number was active, Hon. Habib who was seated next to Hon. Dominic Nitiwul in the gallery sent 500 cedis to the number which amount was deducted from his momo wallet, and a transaction reciept sent from MTN to Hon. Habib's line. This was brought to the attention of the Court whereupon the Court was convinced that the number was indeed active.
The Court after a lengthy conference on the Bench drew their ruling and read same in Court. The Court ordered substituted service through whatsapp on Mr. Wakpal and posting at his home and the notices of the High and District Courts.
The Court ordered for service without the exhibits and ordered the 1st Interested party to get full copies of the application from the Court registrar upon notice of the application.
