In a certiorari application filed on the 1st day of December, 2025 by the embattled Member of Parliament, Hon. Matthew Nyindam through his lawyer, the learned Gary Nimako Marfo, the MP seeks the Supreme Court to quash the judgment of the Tamale Higfh Court delivered on the 24th day of November, 2025 which anulled the elections of Kpandai Constituency and ordered the Electoral Commission to rerun the polls.
In the 16-paged application of Hon. Nyindam, the Supreme Court's supervisory jurisdiction is invoked on gorunds of lack of jurisdiction of the High Court Presided by Justice Bart-Plange Brew for hearing an election petition filed out of time per the rules of Court and The Representation of Peoples Law PNDCL 284, section 18.
The Application deposes to the fact that the petition was filed 32 days after the gazetting of the results of Kpandai Constituency, some 11 days outside the statutorily provided period for the filing of a petition challenging the results of a parliamentary election.
Below is the certiorari application of Mr. Nyimdam which is due for hearing by the Court on Tuesday, the 16th day of December, 2025, some 7 days ahead of the 30 day timeline order handed down to the Electoral Commission to organize fresh elections in Kpandai Constitutency.
