The Concept Of Family: A Vexed Issue In Our Legal Jurisprudence

It is my view that any time an issue as to what a family is, who the members are, who the head is, who can sue on behalf of a particular family, becomes an issue in litigation, an adjudicator must hasten slowly to come to a conclusion because of the complexity of the issue. The adjudicator must resort to the taking of oral evidence to resolve it since it is mostly a question of mixed law and fact where the parties have joined issue. The concept of family is so important in our legal jurisprudence, just as the river Nile is important to Egyptians.
