Legal Literacy on Surrogacy In Ghana: What It Involves and the Legal Challenges that Must Be Borne In Mind Currently and In the Not-Too-Distant Future

The modern statutory law of adoption is principally contained in the Children's Act, 1998 (Act 560), as amended and the Adoption Rules 2003 (C.I.42). The Act regulates the making of adoption orders and places the welfare and best interests of the child at the center of decisions affecting children. Adoption is therefore distinguishable from the comparatively temporary or custodial character of fosterage: it is intended to create a legally recognised familial relationship rather than merely transfer responsibility for day-to-day care.
