The Accra Circuit Court 7, Presided by the respected Sedinam Awo Kwadam, additional Circuit Court Judge in a judgment dated the 16th day of February, 2026 has applied the Supreme Court case of AMA SERWAA v. GARIBA HASHIMU & ANOR [TLP-SC-2021-30], equitable principles and the law of constructive trust to refuse the relief of ejectment against a woman from an East Legon property .
The Court in an elegant application of the law on breach of promise to marry and equitable principles prevented the loss of properties and interest in properties by the Defendant which she assisted the Plaintiff to acquire during the pendency of their 11-year relationship.
In a summary of the full judgment of the Court, the Court dismissed a premature strike to the Counterclaim of the Defendant on grounds of Statute of Limitation brought by the Plaintiff through his lawyer, Selorm Dey Esq., The Court upheld the arguments on statute of limitation and the reliefs of the Defendants per her Counterclaim.
