On or after 9:30am today, the 16th day of April, 2025, the Highest Court of the Republic of Ghana, Presided by the respected Professor of Law, Her Ladyship Justice Prof. Henrietta Mensah Bonsu shall hear the injunction application filed by Ekow Vincent Assafuah against the removal processes of the learned Chief Justice, Her Ladyship Justice Gertrude Esaaba Sackey Torkonoo kicked into motion by the President upon petitions for the removal of the Chief Justice.
The hearing of the injunction comes off after the failure of the Supreme Court to hear same last week on the 9th day of April, 2025 owing to the absence of the Attorney-General and his lieutenants on grounds of an ECOWAS Court training event.
The learned former Attorney-General, Godfred Yeboah Dame, famed for a command of the Supreme Court rules, sharp constitutional law argumentation and many victories for Ghana in international arbitration cases shall cross swords with the current Attorney-General, Dr. Dominic Akurintinga Ayine, who now shoulders the President's burden of delivering on the much touted Operation Recover All Loot (ORLA) campaign promise.
Arguments and evidence by both sides
The Applicant, Ekow Vincent Assafuah Esq., Member of Parliament (MP) for Old Tafo deposes to the fact that the failure of the President to present copies of the petitions against the Chief Justice to her, prior to the consultation with the Council of State is violative of the letter and spirit under girding the 1992 constitution of the Republic of Ghana. The Attorney-General resists the application of the MP through the depositions made by the learned State Attorney, Reginald Odoi Esq. The State's Lawyer relies on mootness and the precedent of the removal processes of the Chief Justice inviting the Supreme Court to dismiss the application of the Applicant and MP for Old Tafo brought on his behalf by Mr. Odoi's former Boss, the respected Godfred Yeboah Dame. Second application for injunction
The Supreme Court panel shall again hear another injunction application brought by one Ebenezer Osei-Owusu for similar reliefs as that brought by Mr. Assafuah in the case numbered J1/19/2025.
