The Ghana Bar Association (GBA) through its Secretary, the learned Kwaku Gyau Baffour has shot down the Circular of the Judicial Secretary dated 5th February, 2026 aimed at "streamlining" the execution of judgments against the State by way of garnishee proceedings.
In the Circular of the Judicial Secretary dated 5th February, 2026 to all Court Registrars, the Judicial Secretary is to be notified of execution processes who shall give appropriate directions before execution.
In a sharp rebuttal dated today, the 23rd day of February, 2026, the Ghana Bar Association relying on the State Proceedings Act, 1998 (Act 555) suggests to the Judicial Secretary that the said order to Court Registrars is alien to Ghanaian Law and thus, a demand for immediate withdrawal.
The letter of the GBA is copied to the Hon Chief Justice, the Deputy to the Judicial Secretary and the Manager of the Accra Court Complex. Below is the Circular of the Judicial Secretary and the rebuttal from the GBA.
