Joana Quaye, ex-wife of the famous Richard Nii Armah Quaye has filed, on the 1st day of April, 2026, an appeal against the decision of the High Court dissolving her marriage with Richard Nii Armah Quaye and distributing some properties acquired during the subsistence of her marriage.
The Notice of Appeal brought on behalf of the aggrieved ex-wife by the respected former Attorney-General and Minister of Justice, Godfred Yeboah Dame, seeks declarative reliefs from the Court of Appeal setting aside the final orders of the High Court Presided by Justice Dorgu who sat as an Additional High Court Judge of the Family Court to deliver the impugned decision.
Per a ground of Appeal raised in the Notice of Appeal filed by Mr. Dame on behalf of Mad. Joana Quaye, a copy of which can be read/downloaded below, "The learned trial judge committed a fundamental error of law by failing to recognise that all the immovable and movable properties claimed by respondent, including shares in companies, were acquired during the subsistence of the marriage and thus constitute marital property to be distributed equitably between the parties."
In particularizing the error of law raised as a ground for the Court of Appeal to set aside the decision of the High Court, Lawyers for Ms. Quaye averred as follows; "The learned trial judge committed a fundamental error of law by failing to recognise that all the immovable and movable properties claimed by respondent, including shares in companies, were acquired during the subsistence of the marriage and thus constitute marital property to be distributed equitably between the parties."
Orders of the High Court
The High Court settled 1/3 of a house in Dansoman on the Appellant and 2/3 of the said house on Mr. Richard Nii Armah Quaye. The Court gave a lump sum of GHc300,000 to the Appellant instead of 50million prayed for, and gave custody of their three children to her with visits and school vacation access and custody for Mr. Quaye.
