The Supreme Court has quashed the judgment of the Tamale High Court Presided by Justice Emmanuel Bart-Plange Brew where the High Court annulled the parliamentary election results of Kpandai Constituency and ordered a rerun of the elections.

The Supreme Court has thus upheld the application filed by Hon. Mathew Nyindam on the 1st day of December, 2025. The Court uphled the arguments of the learned Gary Nimako Marfo that the election petition of the Petitioner, Nsala Wakpal was brought in breach of the timelines for the filing of an election petition.

Section 16 of the Representation of the People Law, 1992, PNDCL 284 provides for the filing of an election petition within 21 days after the gazetting of elections results. The results of the elections of Kpandai constitutency was gazetted on the 24th day of December, 2024 while the Petition was filed on the 25th day of January, 2025.

This according to the Supreme Court in reliance on the cases supplied by the Applicant through his lawyer, Mr. Marfo, invalidated the filing of the petition when the timeframe for filing had elapsed

The Court waived cost against the interested parties and said the full reasons of the Court shall be available later. The panel of the court was Pwamang (Presiding), Amadu Tanko, Kulendi, Asiedu and Kwoffie JJSC. Justice Pwamang who dissented in Ex Parte Ernest Kumi also dissented in the application of Hon. Mathew Nyindam.
